Purpose

    • The purpose of these General Terms and Conditions of Sales (“Terms and Conditions”) is to explain and regulate the conditions of access and use of the website https://risetdecor.com (hereinafter referred to as the “website”) by natural individuals that visit the Website (customers). In addition, these Terms and Conditions set out the contractual conditions that apply to the purchase or rental of any product on the website: since the order, including payment’s methods and the delivery’s conditions of the ordered products, as well as all information about exchanges, returns, and refunds.
    • By browsing the website, customers declare that they have the legal capacity to do so.

 

General Provisions

    • The website’s management and operationalization, as well as sales and rentals, are the responsibility of the company MAGNAPENTAGON, LDA UNIPESSOAL, with registered office at Rua Ferreira Borges Nº 165, 3º andar, Santa Isabel, Campo de Ourique, Lisboa; with the email address info@risetdecor.com; collective entity nº 515120928, and registered in the Commercial Registration Office of Lisbon under the same number. The company possesses a share capital of 100€ (one hundred euros) hereinafter referred to as Ri.Set Decor & Design.
    • The use of the website, purchases, and rentals by the customers, implies the acceptance of the general conditions of use that are described in these Terms and Conditions document.

 

Website’s Use

    • Type of Clients
      • General Clients – clients may explore the website as general Clients, meaning that the general access is not subject to any prior registration. Clients can browse the website and access the content that is available to the public in general.
      • Registered Clients – to access an extra set of features of the website, general Clients need to register on the website by creating a client account. For this purpose, the Client must register by completing the registration form that is available on the website.
      • By creating a Customer account, the Customer is responsible for the accuracy and veracity of the data provided to Ri.Set Decor & Design. In case of non-compliance with the described General Conditions or the incorrect use of the website, Ri.Set Decor & design can the right to block or cancel the Customer’s registration.

 

Website’s Contents

    • The images, layouts, general and specific features, as well as all other content presented on the website are intended for the use by the Customer in the context of the functionalities provided on the website, and they cannot be copied, reproduced, or used beyond the scope of the navigation on the Ri.Set Decor & Design website.
    • The displayed images are exclusively intended to illustrate the indicated products and are not subject to any commercial transaction between the Customer and Ri.Set Decor & Design.
    • The website was optimized for display in various resolutions on mobile devices, and Ri.Set Décor & Design is not responsible for any issue related to the visualization of the website.
    • The color tones of the product’s images displayed on the Customer’s screen may appear different from reality. This depends on factors that are completely out from Ri.Set Decor & Design sphere of responsibility, such as the characteristics of the Customer’s computer equipment, or the customization of the display on screens.

 

Intellectual Property on the Website

    • Set Decor & Design reserves all intellectual property rights (including trademark, logo, patent, copyright, and business secrets, among others) in what regards the website. Any content displayed on the website and its social networks, namely information, images, photographs, videos, drawings, layouts, or any other, are owned by Ri.Set Decor & Design, or licensed to Ri.Set Decor & Design by third parties. The customer’s navigation on the website or the creation of a customer’s account does not imply any transference to the customer of any intellectual property rights about the mentioned content.
    • Customers cannot produce, copy, communicate, disclose to third parties the website contents, or use them for any purpose other than the browsing allowed under these Terms and Conditions.

 

Selling and renting products in the Store and on the Website

    • Process of ordering products
      • To purchase products through the website, Customers must select the products listed in the virtual store on the website, and complete the order by checking out in the shopping cart. The customer needs to click on a button or similar function that identifies that the order implies a payment.
      • In the case of orders that need to be delivered, the Customer must inform correctly the telephone number and the address where the order should be delivered, and the customer is responsible for ensuring that Ri.Set Decor & Design register data correctly.
      • After the completion of the order, Ri.Set Decor & Design will acknowledge the receipt of the order by sending an order confirmation to the email address indicated or used by the Customer, which will include the main information about the order.
      • The sales contract between Ri.Set Decor & Design and the Customer is concluded after receiving the receipt of payment for the product(s); Ri.Set Decor & Design will confirm the conclusion of the contract by sending an email to the customer within five days at most.
      • These Terms and Conditions, as well as the order acknowledgment, will be communicated in a way that will allow the Customer to store and reproduce them, including on its equipment.
      • After the order’s payment by the Customer, it will no longer be possible to modify the order’s data.
      • Customers will have access to their order status in their personal area of the website.
      • These conditions are applied to Ri.Set Decor & Design products on the website. In case of stock divergence, the Customer will be informed and may choose to cancel the order or to order any other similar product at the same price.
      • In case of unavailability of any product (out of stock), the Customer will be informed about similar products with an equivalent or higher quality.
      • If the Customer cancels the order and do not place a new order within 5 days, we will refund any amount paid regarding any unavailable products within 14 days.

Prices

    • The sales prices published on the website are presented in euros. These prices include all taxes and fees required by law. Rental prices can vary depending on the rental period, the number of goods, and extra services that may be requested.
    • Set Decor & Design reserves the right to change the sales and rental prices at any time. Such modification will be made under the current legislation. These price changes will only be valid for orders after the announcement of the new prices.
    • In case of any price reduction of any item after placing the order, the price difference concerning the initial price will not be refunded.
    • In the case of rental products, a security deposit may be requested and will be returned upon proper review of the items. This amount will be retained in case of damage or non-return.

 

Payment Methods Available on the Website

    • On the website, Customers can pay their orders through two different methods:
      • ATM Reference: an ATM reference is generated during the payment process and the order will only be processed after the payment confirmation;
      • MB WAY (via smartphone): instant payment;
      • By bank transfer, which will require Customers to send an email with the proof of payment.
    • The ownership of the sold items passes to the Customer only on the date on which the following requirements are simultaneously fulfilled: full payment of the item(s) to Ri.Set Decor & Design and the delivery of the item(s) to the Customer.
    • The ownership of the rented items will always belong to Ri.Set Decor & Design at all times, regardless of the location of the items.

 

Shipment and delivery methods available

    • Except for rentals and extraordinary circumstances, we will ship the ordered product(s) at the date indicated in the order confirmation (considering the delivery method selected by the Customer). If no delivery date is specified, the order will be delivered within 30 days from the date of the confirmation order, except custom-made items, or items that are expected to be available in the future. In these two cases, the delivery date may take longer than 30 days. In the case of rentals, the delivery of the items is made at our warehouses with a previously arranged date and time.
    • Delays may also occur due to unforeseen circumstances (e.g. high order flow or problems in the delivery area). The order will be processed on the date indicated in the order form. If it is not possible for us to meet the delivery date for any unrelated reason, the Customer may establish a new delivery date with the transport company that was hired for this purpose.
    • Set Decor & Design does not make deliveries or pick-ups on Sundays or bank holidays.
    • In the case of the sale of products, the delivery charges are calculated at the time of purchase and communicated before completion of the order.
    • Whenever the object of the delivery does not fit in the driveways, the delivery is considered made on the first floor of the address.
    • For these Terms and Conditions, an order shall be deemed to have been delivered when the Customer or any third party nominated by the Customer takes physical possession of the products, which shall be evidenced by the signing of the order receipt record.
    • For the continental domestic service, the maximum weight of the volumes we transport is 30Kg and the maximum volume is 0,25 m3 (the total of the 3 dimensions must not exceed 1,60m and the largest measure must not exceed 1,20m). In the case of international road service, the maximum weight of the volumes we transport is 31,5Kg and the total of the 3 dimensions must not exceed 3,00m, calculated using the formula “length cm + 2 x (width cm + height cm)”. The maximum length is 1.75m. If the shipment exceeds the dimensions and is accepted by the DPD network, there will be an additional payment fee of 26.00€. Volumetric weight is also applied to this service whenever it is greater than the real one, calculated by the formula “width cm x height cm x length cm/5000”. Volumetric weight applies to the International Air and Islands service and whenever it is greater than the real weight of the order (according to the calculation formula: width cm x height cm x length cm/4000 in the case of the Islands, and width cm x height cm x length cm/5000 in the case of international services). Volumetric weight is applied in shipments to the Spanish Islands whenever it is greater than the actual weight of goods, through the formula width cm x height cm x length cm/volumetric ratio. Volumetric ratios: Balearic Islands, Ceuta: 5000; Canary Islands and Melilla: 300.
    • In Ri.Set Decor & Design there is only one small package delivery option: standard delivery.
    • Our domestic pickups and deliveries are made from Monday to Friday, excluding public holidays. You may request delivery for Saturdays in certain types of shipments.
    • In the purchase option, the order is delivered to the address indicated and selected by the Customer for this purpose. If the Customer is not at the address indicated, a postcard is left or an SMS is sent with the necessary instructions for rescheduling or picking up the same at a pick-up point closest to the indicated address. The carrier, in the case of delivery of small volumes, will store the order for 5 days. After that, if there is no rescheduling delivery, the items will be returned to Ri.Set Decor & Design. If rescheduling is needed the Customer should contact DPD by phone at 21 854 6001.
    • Orders that are larger than 30 kg or more than 0.25 m3 or larger than 1.20 meters (shipping box) are considered large volume orders.

 

  1. Large volume deliveries are made between 9:00 a.m. and 7:00 p.m. Monday to Friday, delivered within 72 hours from dispatch of the order by Ri.Set Decor & Design or, where possible, on the date selected by the Customer. This delivery method is divided into 2 zones, where zone 1 corresponds to a set of zip codes in the Lisbon region and zone 2 applies to the rest of mainland Portugal.

 

  • The Customer will receive a confirmation SMS or an email with the data for the proper receipt of the order.
  • The order is delivered to the address that appears on the Customer’s order request and selected for that purpose. If the Customer is not at the address indicated, a postcard is left or an SMS is sent with the necessary instructions for rescheduling or picking up the same at a pick-up point closest to the indicated address. The carrier, in the case of large volumes, will store the order for 8 days. After that, if there is no rescheduling delivery, the items will be returned to Ri.Set Decor & Design. If rescheduling is needed the Customer should contact DPD by telephone at 21 854 6001.
  • Proof of delivery will be provided by the consignee’s signature on the respective delivery sheet / digital terminal, presented by the delivery driver, in two places: receipt of the items and conformity of the items. At that time, the Customer must examine the items to detect any damage, shortages, defects, or other visible problems or to determine the non-compliance of the products delivered with his order. In particular, he/she must check the condition of the packaging, the number of packages, the quantities, references, conditions, and the characteristics of the products.

 

Legal and Commercial Warranties

Legal Guarantee of Product Conformity

      • According to the applicable consumer guarantees, Ri.Set Decor & Design warrants that the products sold conform to the characteristics as advertised for 2 years from the delivery of the product. In the case of products intended for professional use, Ri.Set Decor & Design provides a voluntary, free of charge, 1-year warranty.
      • For the preceding paragraph, the non-compliance with the contract shall not be deemed to exist if, when the contract is concluded, the Customer is aware of or cannot reasonably be unaware of such non-compliance or if the non-compliance is the result of improper use by the Customer.
      • If the Customer believes that there is an issue in the product(s), Ri.Set Decor & Design should be informed as soon as possible by e-mail to info@risetdecor.com with the following documents: invoice number, date of purchase, holder’s name, and a photograph describing the issues found in the item(s).
      • If the product is under warranty, Ri.Set Decor & Design will examine the presented issues, and will offer a solution at its discretion, including replacement, repair, or other potential solution agreed with you.
      • The costs associated with the return by pickup/mail of the goods due to the exercise of the legal guarantee of conformity of the products shall be supported by Ri.Set Decor & Design
      • The legal warranty of conformity of the goods is independent of the other rights of the Customer outlined in the following sections, which are in addition to it.
      • The following are not considered defects in the products sold, in particular handcrafted products, characteristics of natural materials used in production: variations in grain, texture, knots, and color. Normal deterioration from use is not considered a defect.

 

  • Right to Free Contract Termination (Shopping on the Site)
    • Under applicable law and subject to the exceptions provided for therein, the Customer has the right to freely terminate the contract signed with Ri.Set Decor & Design within 14 days from the day indicated by the Customer or a third party indicated by the Customer, except the carrier, acquires physical possession of the products in the order.
    • The right of Free Resolution only applies provided that the products are in perfect condition for sale and proper conditions of use, in the original state as purchased, including packaging.
    • The Customer may exercise the right to free termination of the Contract within the above-mentioned period, without incurring any costs, without the need to state a reason, upon request by e-mail to info@risetdecor.com.
    • The Customer shall use the following information in the request:
  • Consumer(s) name
  • Address of consumer(s)
  • Product(s)
  • Date
    • Set Decor & Design will reimburse the Customer for all payments received within 14 days from the date of the receipt of the communication of the Customer’s decision to freely terminate the Agreement. This will include the price paid for the products and any associated delivery costs (except additional delivery costs for special services specifically requested by the Customer or additional delivery costs when the Customer expressly requests a different, more expensive method of delivery than that offered by Ri.Set Decor & Design).
    • Where the products are to be returned by the Client, Ri.Set Decor & Design will only process the refund after receipt of the products or proof that the Client has returned the products to Ri.Set Decor & Design.
    • Set Decor & Design will collect the Products where, due to their nature and/or size, the Products cannot be returned by mail.
    • Set Decor & Design shall bear the costs associated with the return of the goods by mail/courier collection due to the exercise of the right of withdrawal.
    • The Customer shall return the products to Ri.Set Decor & Design in a usable condition and Ri.Set Decor & Design may charge the Customer for any damage caused to the products in the period preceding the right of withdrawal.
    • The reimbursement of payments made by the Customer will be processed for the same means of payment that has been used to pay for the product(s). If it is impossible to use the same means of payment used in the order, the refund will be made by bank transfer to the IBAN indicated by the Customer.
    • The Customer does not enjoy the right to free termination of the contract when:
  1. the supply of the product(s) made under Customer’s specifications;
  2. which are subject to manifest customization;
  • the supply of the product(s) which, by their nature, cannot be returned or are likely to deteriorate;
  1. the supply of the product(s), which, after delivery and by their nature, are inseparably mixed with other products.

 

  • The Customer’s right of free withdrawal under applicable law and this Clause is independent of the commercial guarantees explained in the general terms of guarantees.
  • The conditions for returning the products referred to in this Clause are only applicable to the exercise of the right of free resolution, and do not extend to the commercial guarantees referred to in the following Clause, called “COMMERCIAL EXCHANGES AND RETURNS”.

Exchanges and Returns

    • The Customer may exchange or return any article for 30 days after delivery, presenting the invoice. The article must be in perfect saleable condition, as well as have its original packaging and not violated.
    • The following items are not covered by the exchange and return policy: sale items, opportunities, seasonal (Ex: Christmas decorations), and personalized items.
    • Exchanges and returns can be made in 2 different ways:
  • At a DPD pickup point where packages can only be up to 10 KG;
  • Through home pickup by request to Ri.Set Decor & Design Customer Service.

 

  • For returns, the value of the order will be refunded, but the costs of delivery and possible collection must be borne by the customer. Only the costs indicated above will be refunded if under warranty or by exercising the right of free resolution.
  • For returns, the refund will only be made after the physical receipt of the products by Ri.Set Decor & Design. The verification of objects will be done within a maximum period of 14 days and for the same means of payment used by Customer in the order.
  • The returns of rental items will be made on a date and time previously agreed in our warehouses.

Suggestions and complaints

    • The Client may send suggestions or complaints to the e-mail info@risetdecor.com or through the Electronic Complaints Book available on the Site.

Jurisdiction Clause

    • These Terms and Conditions are governed by Portuguese Law, being the Civil Court of the District of Lisbon competent to judge all issues arising from them, expressly waiving any other.

Amendment of the terms and conditions.

    • Set Decor & Design reserves the right to change these Terms and Conditions without notice and any changes will be published on the Site. The Client should consult the Terms and Conditions regularly to take notice of any changes.
